By joining or using the Sugarplum Socials Discord community you agree to the following terms. Please read them carefully.

第1条
Scope & Acceptance
  • These Terms and Conditions (hereinafter "Terms") govern all use of the Sugarplum Socials Discord community (hereinafter the "Service") operated by Sugarplum Socials (hereinafter the "Operator").
  • By joining, accessing, or participating in the Service in any capacity, you (hereinafter "User" or "Member") unconditionally agree to be bound by these Terms in their entirety.
  • If you do not agree to any part of these Terms, you must immediately cease use of the Service and leave the community.

Age & Eligibility
  • The Service is strictly restricted to individuals who are 18 years of age or older. By accessing the Service you represent and warrant to the Operator that you are at least 18 years of age under the laws of your country of residence.
  • The Service contains adult-oriented content including, but not limited to, sexually explicit themes and discussions of kinks and fetishes. Users below the age of legal majority in their jurisdiction are strictly prohibited from accessing the Service.
  • The Operator reserves the right to permanently ban any User found to be under the age of 18 and to report such access to relevant authorities where legally required.

Definitions
  • "Service" refers to the Sugarplum Socials Discord server, its associated channels, roles, events, and any related platforms operated by the Operator.
  • "Content" means any text, images, videos, audio, links, roleplay scenarios, or other material posted, shared, or transmitted by any User within the Service.
  • "Staff" refers to server administrators, moderators, and other individuals designated by the Operator to maintain and manage the Service.
  • "Discord" refers to Discord Inc. and its platform through which the Service is delivered. Discord's own Terms of Service and Community Guidelines apply independently of and in addition to these Terms.

Community Rules & Conduct
  • All Users must treat fellow members with basic dignity and respect. Harassment, stalking, doxxing, or intimidation of any kind is strictly forbidden.
  • All Content shared within the Service must remain fictional and consensual in nature. Promotion of, glorification of, or requests for real-world non-consensual acts are prohibited.
  • Users must label explicit Content appropriately and post it only in designated NSFW channels. Posting adult Content in non-NSFW channels will result in immediate removal and potential ban.
  • The Operator and Staff have final authority over conduct and Content moderation. Staff decisions regarding warnings, mutes, kicks, or bans are binding.

Prohibited Acts / 禁止事項
  • The following acts are strictly prohibited and may result in immediate permanent ban and, where applicable, reporting to law enforcement:
  • (1) Posting, sharing, or soliciting child sexual abuse material (CSAM) or any Content that sexualises minors in any form;
  • (2) Sharing real people's personal information without their explicit consent (doxxing);
  • (3) Sharing or soliciting real-name, address, financial, or other private information of any individual;
  • (4) Impersonating the Operator, Staff, or other Users with the intent to deceive;
  • (5) Using the Service to promote, facilitate, or conduct any illegal activity under Japanese law or the laws of the User's jurisdiction;
  • (6) Sending spam, automated messages, unsolicited links, or malicious software;
  • (7) Attempting to circumvent bans, moderation actions, or Discord's safety systems.

Intellectual Property
  • Users retain ownership of original Content they create and share within the Service. By posting Content, Users grant the Operator a non-exclusive, royalty-free, worldwide licence to display, reproduce, and share such Content within the Service for operational and promotional purposes.
  • The Operator's name, logo, branding, and any original materials produced by Staff remain the exclusive property of the Operator. Reproduction or commercial use without prior written consent is prohibited.
  • Users must not upload Content that infringes the intellectual property rights of third parties. The Operator will remove infringing Content and may suspend or ban Users responsible for repeated infringement.

Disclaimer of Liability / 免責事項
  • The Service is provided on an "as-is" and "as-available" basis. The Operator makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of the Service or its Content.
  • The Operator shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to loss of data, emotional distress, or reputational harm.
  • The Operator is not responsible for Content posted by Users. Each User is solely responsible for the Content they produce and the consequences of sharing it.
  • The Operator disclaims all liability for actions taken by Discord Inc. including service disruptions, account terminations, or platform-level policy changes that affect the Service.

Privacy & Personal Data
  • The Operator does not independently collect personal data beyond what is necessary for community management (e.g., Discord user IDs and usernames visible through the Discord platform).
  • Any data collected or processed is handled in accordance with the Act on the Protection of Personal Information (個人情報の保護に関する法律, APPI) of Japan.
  • Discord Inc. processes personal data as data controller under its own Privacy Policy, available at https://discord.com/privacy. Users are advised to review Discord's Privacy Policy independently.
  • Requests relating to access, correction, or deletion of personal information held by the Operator may be submitted via the contact details provided in Article 11.
第9条
Amendments
  • The Operator reserves the right to amend these Terms at any time without prior notice. Amended Terms shall take effect upon their posting within the Service or on the Operator's associated platforms.
  • Continued use of the Service after any amendments constitutes acceptance of the revised Terms. Users who do not agree to the amendments must leave the Service.
  • The Operator endeavours to notify Users of material changes via announcements in the Service where reasonably practicable.

Governing Law / 準拠法
  • These Terms and all matters arising from them shall be governed by and construed exclusively in accordance with the laws of Japan (日本法), without regard to conflict-of-law principles.
  • Relevant statutes include but are not limited to: the Civil Code of Japan (民法), the Consumer Contract Act (消費者契約法), and the Act on the Protection of Personal Information (個人情報の保護に関する法律).

Jurisdiction & Contact / 裁判管轄
  • Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Tokyo District Court (東京地方裁判所) as the court of first instance.

These Terms are written in English for accessibility. In the event of any ambiguity, the terms shall be interpreted in accordance with Japanese law.
本規約は参照の便宜上英語で記載されていますが、準拠法は日本法です。
